A WORD ON TRADEMARK LAW:
When starting a business, especially in the State of Illinois, it is imperative to conduct a thorough search at the onset. Many businesses neglect this action in an attempt to be cost efficient.

The trademark search conducted by the Illinois Secretary of State during the incorporation process does not constitute a Federal search but rather, a search against other Illinois Corporate names.  A more thorough search must be conducted on the national and potentially international level to ensure that the proposed name is available for use by your Organization.

Your Organization may invest time and money to design, build, and erect signs, print flyers and catalogs, build websites and utilize its name on other media sites.  If a thorough trademark search is not conducted, your Organization risks being served with a “Cease and Desist” letter after garnering goodwill associated with its name.   Your Organization may eventually be forced to change its name or face an infringement suit in the Federal Courts.
